Terms of use

Last updated:

These terms apply to the Žirgynai.lt website and to everyone who uses it: visitors, stables, competition organizers and gift voucher buyers. You may use the site only in line with these terms.

Who runs the site

The site is run by MB VBNetwork (company code 307791342, registered address Mokyklos g. 62 K9-31, LT-00303 Palanga). You can reach us at [email protected].

Definitions

These terms use the following definitions:

  • The Operator (also “we”) is MB VBNetwork, which runs the Žirgynai.lt website and the stable marketplace on it.
  • A Stable is a stable’s owner or representative who has an account, buys a listing plan from the Operator and may sell gift vouchers for its services through the site.
  • A Voucher Buyer is a natural person who buys a stable’s gift voucher through the site, for themselves or as a gift.
  • A Visitor is anyone who browses the site.
  • An Organizer is anyone with an account who publishes horse competitions on the site.

What the service is

Žirgynai.lt is a stable marketplace. The Operator publishes information about stables, sells listing plans to stables and acts as an intermediary when they sell gift vouchers. The Operator does not provide riding or other services. Visitors arrange lessons, camps and other services directly with the stable, and that stable’s terms govern their relationship. Organizers can also publish horse competitions on the site. The Operator does not run them, and riders enter with the organizer.

Accuracy of information

We try to keep the directory accurate, but the details come from the stables themselves or from public sources. Always confirm prices, opening hours and service terms with the stable. If you spot a mistake, let us know through the contact form.

How stables are ranked

The order of stable lists is set by these main criteria:

  • Partner and premium listings are shown first and carry a “Partner” badge, because they are paid placements. Premium listings are shown before partner listings.
  • Listings on the same plan swap places every day, so none of them keeps the top spot.
  • Other listings are sorted by the stable’s name.
  • Search results are ranked by how well a stable matches the search. The plan does not change that order.
  • The homepage shows premium stables, which swap places every day.

For stables: the catalog listing

A Stable with an account can describe its stable and order a yearly listing in the catalog. We review every new listing and every change before it is published. We may ask for corrections or decline to publish a listing that does not meet these terms.

For stables: listing content

The Stable is responsible for the accuracy of the listing’s description, contacts and photos. By publishing photos, the Stable confirms it has the right to use them. It grants the Operator a free, non-exclusive right to show the listing’s content on the site and in its advertising while the listing runs.

For stables: obligations

When using the site, the Stable undertakes to:

  • give accurate, up-to-date information about its services, their terms, age limits, required clothing and safety rules
  • hold every permit the law requires and follow the safety rules when providing its services
  • tell customers its service terms before providing a service
  • update the listing and inform customers without delay when a service changes or cannot be provided
  • take care of its own taxes and the accounting documents needed when selling services and gift vouchers
  • use customers’ data received through the site only to provide the service, and handle it in line with the GDPR
  • sell gift vouchers only as a trader, in the course of its business, and tell the Operator if that changes

For stables: selling gift vouchers

A Stable may sell gift vouchers for its services through the site. The Stable sells each voucher in its own name and is its seller. A voucher is paid for by card through a licensed payment service provider, which passes the Stable its share, or by bank transfer straight into the Stable’s bank account.

  • For buyers to pay by card, the Stable opens a payout account with the payment service provider and accepts that provider’s terms, which it presents when the account is opened.
  • For every voucher sold, the Operator receives the commission of the Stable’s plan, and at least €3. On a card payment, the commission is deducted from the voucher price at the time of payment.
  • On a card payment, the rest goes to the Stable’s payout account and is paid out to its bank account 14 days after the payment.
  • The Stable undertakes to provide the service stated on the voucher to its holder for as long as the voucher is valid.
  • If the Voucher Buyer withdraws from an unused voucher within 14 days, they get the full amount back. On a card payment, the Stable’s share is taken from its payout account, and the Operator returns the commission.
  • If the Stable cannot provide the service, the Voucher Buyer gets the full amount back. The Stable covers all of it, the Operator’s commission included.
  • If the Stable’s payout account does not hold enough for a refund or a dispute, the shortfall is taken from its future earnings or debited from its bank account as the payment service provider sets out. Any amount that cannot be recovered that way, the Stable pays to the Operator within 14 days of the Operator’s request.
  • If a Voucher Buyer disputes a payment with their bank, the disputed amount and the payment service provider’s dispute fee are taken from the Stable’s payout account. If the bank decides the dispute in the Stable’s favour, the disputed amount is returned to that account, but the dispute fee is not.
  • Instead of a payout account, a Stable may give its bank account. The buyer then pays for the voucher by bank transfer straight into it, and the Operator neither receives nor passes on that money.
  • On receiving the buyer’s payment, the Stable confirms it in its account within 7 days of the order. The buyer is then sent the voucher. If no payment came, the Stable marks it so, and the order is cancelled.
  • If the Stable neither confirms nor rejects the payment within that time, the Operator may treat the payment as received and send the buyer the voucher when it has reason to believe the buyer paid. Otherwise an unconfirmed order is cancelled.
  • The Stable must confirm every payment it receives for a voucher ordered through the site. Leaving a received payment unconfirmed, or completing such a sale outside the site, breaches these terms, and the commission is still payable.
  • For vouchers sold by bank transfer, the Operator issues a commission invoice each month, which the Stable pays within 14 days by bank transfer to the Operator’s account given on it.
  • If the invoice is not paid on time, the Operator pauses the Stable’s gift voucher sales at once and tells the Stable so, and why, by email. Sales resume once the invoice is paid.
  • For a voucher paid by bank transfer, the Stable returns the money to the buyer itself and marks it so in its account. If the money is returned within 14 days of the payment, no commission is charged on that voucher.

For organizers: competition listings

The price of a competition listing is shown before you pay and is final. While the launch offer announced on the site runs, we publish competitions free of charge.

  • We review every new competition within 1-2 business days. Once approved it shows on the site at once, and the organizer's later changes show without another review.
  • If we can't publish a competition, we refund the full amount paid within 5 business days.
  • The organizer is responsible for the accuracy of the competition's details, programme, photos and results. They are also responsible for the competition itself: running it, its safety, riders' entries and collecting entry fees.
  • The organizer grants the Operator a free, non-exclusive right to show the listing's content on the site and in its advertising.
  • If a competition is cancelled or postponed, the organizer marks it in the listing. The listing fee is not refunded in that case.
  • Listings of past competitions stay on the site as an archive with their results.
  • If you ordered a competition listing as a consumer, you may withdraw within 14 days of paying by writing to us. If the competition is not published yet, we refund the full amount.
  • We may hide a competition listing that breaks these terms, telling the organizer by email and giving the reason. The fee is not refunded in that case.

For voucher buyers: gift vouchers

The Stable sells the gift voucher to the Voucher Buyer, and the Operator acts as an intermediary and, on a card payment, receives the payment. The voucher purchase contract is between the Voucher Buyer and the Stable. Stables sell gift vouchers as traders, in the course of their business.

  • A voucher paid by card is emailed straight away, and one paid by bank transfer once the stable confirms the money has arrived. It is valid for 12 months from the day of payment.
  • A voucher can be given away: anyone who has its code can use it. It cannot be exchanged for cash.
  • To use it, contact the stable, agree on a time and give the code. The stable is responsible for the service and its terms.
  • You can withdraw from an unused voucher within 14 days of payment by writing to us. For a voucher paid by card we refund the full amount the same way you paid, and for one paid by bank transfer the stable returns the money.
  • If the stable cannot provide the service, the full amount is refunded (for a voucher paid by bank transfer, by the stable). A used or expired voucher is not refunded.
  • Raise any complaint about the service with the stable, and write to us at [email protected] about the payment.
  • The Voucher Buyer’s obligation to pay is fulfilled once the payment service provider receives the payment or, on a bank transfer, once the money reaches the stable’s bank account.
  • When paying by bank transfer, give the voucher number as the payment reference. If the stable does not confirm the payment within 7 days, the order is cancelled, unless we have reason to believe you paid. The payment then counts as received and the voucher is sent.

Complaints

Send complaints about the site, a listing plan or a payment to [email protected]. Describe what happened and attach any related documents you have. We will answer within 14 days of receiving the complaint. Raise complaints about riding or other services with the stable first.

Account

If you create an account, you are responsible for keeping your login details safe and the information you give accurate. Only adults may create an account or buy a gift voucher. You can delete your account at any time in its settings.

What is not allowed

On the site you may not:

  • post false information or information that infringes other people's rights
  • copy the directory content in bulk by automated means
  • disrupt the site or try to get around its security measures
  • send unsolicited messages through the site forms
  • use other users’ data for any purpose other than the one it was given for
  • list or sell services you are not entitled to provide

Breaches

If a user breaches these terms, the Operator may:

  • warn the user and ask them to put the breach right
  • hide a listing or suspend gift voucher sales
  • restrict access to the account or close it
  • report unlawful activity to the authorities

We tell the user of each such decision and its reasons by email no later than it takes effect. In serious cases (fraud, for example) we act at once. Otherwise we warn first. A user who disagrees with a decision can write to us, and we will review it.

Ending the contract

  • A Stable can end the contract at any time by deleting its account. While gift vouchers the Stable sold are still valid and unused, the account cannot be deleted. A paid plan fee is refunded only in the cases these terms provide for.
  • The Operator can end the contract by telling the Stable so, and why, by email with at least 30 days notice. If the contract ends through no fault of the Stable (for example, because the Operator closes the catalog), the Stable is refunded in proportion to the paid period left.
  • If the contract ends because the Stable breached these terms (for example, it did not provide the services its listing offers, published false information, or justified complaints were received about it), the plan fee for the remaining period is not refunded. For a repeated or serious breach, the Operator can end the contract at once, telling the Stable so, and why, by email.
  • Obligations under gift vouchers already sold continue after the contract ends, until the vouchers expire.

Intellectual property

The design, texts and code of the site belong to MB VBNetwork. Photos are used under their licences. You may use the content for personal purposes, and any other use needs our written permission.

Limitation of liability

The Operator is not responsible for the quality or safety of stables’ services, as it does not provide them. The stable that sold a gift voucher is responsible for the service on it. The Operator is also not responsible for the content of third-party websites it links to. This does not limit any liability that cannot be limited by law.

  • The Operator’s liability to a Stable does not exceed what the Stable paid the Operator over the last 12 months. The Operator is not liable for a Stable’s lost income or other indirect loss.
  • These limits do not apply to harm caused intentionally or by gross negligence, or to harm to life or health.
  • Neither party is liable for failing to perform these terms because of force majeure it could neither foresee nor control.
  • The Stable compensates the Operator for losses from third-party claims related to the Stable’s services or the content it provides.

Changes to these terms

We may change these terms. The latest version is published on this page with the date it was updated. We tell account holders about material changes by email at least 30 days in advance. If you do not agree to them, you can end the contract by deleting your account.

Governing law and disputes

These terms are governed by the law of the Republic of Lithuania. We first try to settle disputes by negotiation. A consumer who disagrees with our answer to a complaint may turn to the State Consumer Rights Protection Authority (Vilniaus g. 25, 01402 Vilnius, www.vvtat.lt) or to a court. Disputes with stables are settled by the courts of the Republic of Lithuania at the Operator’s registered seat. These terms do not limit consumer rights that cannot be limited by law.

Other provisions

  • If any provision of these terms is found invalid, the others remain in force.
  • If the Operator does not use one of its rights in a given case, it does not waive that right.
  • Notices are sent by email and count as received on the next business day after sending.
  • The Operator may transfer its rights and obligations under these terms to another person after telling users. Users may transfer their rights only with the Operator’s consent.
  • These terms are written in Lithuanian and English. If the texts differ, the Lithuanian one prevails.
